First we need to provide a bit of background for new readers. I apologize to regular visitors to the blog site who will find it all too familiar.

The US Constitution became necessary because the Articles of Confederation, which had been ratified in 1781, proved inadequate. The Articles created an impotent Federal government. While many understood the need to create a stronger central government most feared a system that would give too much power to a national government. The result was the greatest single contract for governance in world history.

The Constitution was finally ratified in 1788 and took full effect on March 4, 1789. The greatest strengths were an array of checks and balances. There were checks between the three branches of the new Federal system but the real achievement was the concept of federalism: the division of power between the central government and the governments of the individual states. The ratification was made possible, in the end, by the inclusion of the Bill of Rights. In order to ensure that significant power was retained at the local level the Tenth Amendment made it clear that all powers not specifically granted to the United States or prohibited to the States were reserved to the States.

Sadly it has been demonstrated too frequently over the course of history that men (read this to include women) will seek personal power and in most cases that power is ultimately exercised at the most centralized level of government. The inevitable result, according to Lord Acton, is that power tends to corrupt and in socialist governments absolute power corrupts absolutely. The federalist system defined by the Constitution managed to avoid such corruption for almost 100 years. Grover Cleveland, our 22nd and 24th President, set records for using his veto power. His message was always: I cannot find support for this bill in the Constitution.

However with the advent of “progressivism” the transfer of power from local to national began. The 16th Amendment gave Congress the power to collect an income tax to finance the progressive agenda. Also in 1913 the 17th Amendment changed the method by which US Senators were elected. Prior to 1913 the state legislatures selected the Senators. To complete the trifecta of 1913 the Congress passed and Wilson signed into law the Federal Reserve Act which essentially nationalized control of the monetary system. The accretion of power in Washington has been a continuum ever since.

Unfortunately this power shift was accompanied by an asymptotic growth of mediocrity among those who would manage our lives. Madison and Washington would weep openly if they had to witness the comical attempts to govern by the likes of Pelosi, Schumer, Swalwell, Schiff and AOC. The so-called “deep state” would be better described as the shallow state. We are witnessing this on a daily basis during our present “crisis”. Herewith a few examples that you may find sobering.

A number of education professionals (oxymoron alert) have made it clear that closing the schools was a huge mistake because parents simply cannot be trusted to teach their children from the correct perspective. In other words it will gum up the propaganda mission in the government schools. The last thing we need is independent thinking.

The Democrats were fierce advocates of State’s Rights when they were suppressing blacks. FDR, and his Charlie McCarthy, LBJ, powered the Democrat charge to transfer all things government to Washington. Federal regulations drove the agenda. Obamacare required everyone to buy the right kind of health insurance. They established the Departments of Education and Energy to create the illusion that they could manage schools and develop new forms of energy that would be required to deal with Jimmy Carter’s (the poster boy for mediocrity) prediction that we would run out of oil by the end of the century. Everyone was conditioned to look to Washington for everything.

Then came the Wuhan Red Death and an accidental intersection with common core math. Suddenly the Democrat governors could count to ten as in the Tenth Amendment. With Trump in the White House the Democrats argued that we couldn’t leave health decisions to someone who “didn’t believe in science”. State’s rights was back in business.

What we got instead was a collision with mediocrity in government. Andrew Cuomo, a beneficiary of primogeniture, has come off as a complete buffoon. He castigated Trump early and often angrily demanding respirators and more hospital facilities. In the end he transferred the respirators to other states and the hospitals handled the virus without event. Nonetheless he took control of the lives of the people of the state of New York and forced compliance with his order to shut down the state.

Illinois gave us JB Pritzker, a man with but one accomplishment…he inherited a ton of money which he used to buy a public office. He brought the economy of his state to it’s knees even as he allowed his family to ignore his stay at home edict. He has been every bit as cavalier about following the rules as Comrade DeBlasio, the incompetent mayor of New York City. Pritzker is positively Bidenesque when he explains and then tries to defend his radical response to the virus.

The governor of Michigan Gretchen Whitmer is a real piece of work. She is a person of little or no accomplishment who would be stunned to learn the the US has an actual Constitution. She has embraced her authoritarian instincts which is what happens when small minded people get their hands on the controls of heavy machinery.

Gavin Newsom, the Ken Doll of governors, is making a total hash of the state of California. Newsom is the master of the platitude. He has impossibly thin skin and throws childish fits when the people deign to disregard his ongoing power grab. He closed the beaches of one county because he didn’t feel they were taking him with adequate seriousness. Big ego, tiny support mechanism.

This megalomania is predicated on the ability of the chattering class to instill fear among the electorate. They succeed because those in power do nothing to address the ignorance that is epidemic in America. The seas are rising, the virus will kill us all, the ozone hole is growing, we are running out of toilet paper. They follow the facts not the truth and they control the dissemination of the “facts”.

That dotty Joe Biden has become the default candidate for the Democrats speaks volumes about our national embrace of mediocrity with just a dash of dementia for good measure. We are seeing for ourselves what happens when you mix low intelligence and senility. Interesting times indeed!

Does absolute power corrupt absolutely or does power itself in the hands of self important people tend to lead to corruption? What we have learned since January 21, 2017 is that concentrated power leads all too often to abuse and a lack of accountability.

A troubling example of this observation is the case of General Michael Flynn. Flynn is an American hero who served his country selflessly for 33 years. This man made the mistake of getting crosswise with the famously hypersensitive Barrack Obama. Obama warned Trump against bringing Flynn into his administration. Andrew McCarthy recently made a compelling case as to why Flynn was targeted. If Flynn became the National Security Advisor he would have to be apprised of the trumped up (pun intended) investigation into the imagined collusion between Trump and Putin. Flynn would then have put at risk the machinations of the anti-Trump cabal that included James Comey, John Brennan, James Clapper, Andrew Weissmann and Peter Strzok, all members of the over achiever hall of fame. And corrupt to boot.

The unethical entrapment designed to get Flynn fired reflects the rankest form of abuse of our judicial and law enforcement systems. The smug overconfidence of powerful mediocrities like Comey and Brennan is a direct result of the concentration of power at the Federal level. Comey et al clearly believe they were not subject to the laws that the rest of us are expected to obey. Has the integrity of the FBI been forever tarnished? Does the intelligence community in the hands of the likes of Brennan and Clapper and their overseers Schiff and Mueller have any credibility left? Is the media comfortable in their role as enablers of the overarching bureaucratic system that operates with no guardrails?

So how do we extract ourselves from the present nightmare, reestablish the rule of law and return power to the people? How do we wrest power from the conceited Ivy League graduates who truly feel they are the best and the brightest, all evidence to the contrary?

Herewith a few modest proposals for consideration and discussion:

  1. Impose term limits on members of the Senate and the House of Representatives. Cap elected service at 12 years in any combination they wish…12 years and out.
  2. No pensions for members of Congress. Serving is a privilege and a sober responsibility not a career opportunity. Ponder this: Biden held elective office for 45 years, Pelosi 33 years, Schumer 39 years, Hoyer 39 years and Leahy 45 years. Trump has been in office for 40 months and according to the lifers everything is his fault.
  3. If the national unemployment level reaches 8 percent the salaries paid to all members of Congress should be suspended.
  4. Upon election every member of Congress must declare his or her net worth. When they leave office they must declare their new net worth. 90% of the increase, if any, goes directly to the Treasury.
  5. Abolish the FBI and most of the intelligence community. You should, of course, make actual intelligence a prerequisite for employment at any agency that has the authority to spy on people.
  6. Abolish the FISA Court. The Carter Page case alone shows the abuse that is possible and apparently the system can be easily manipulated to destroy our freedoms.
  7. Move the entrenched Federal bureaucracy out of Washington closer to their real constituents. Why should the Department of Agriculture reside in the District of Columbia where the only plantings are in window boxes?
  8. End the ability of platforms such as Facebook, Google, Twitter and AOL to censor any content. Everything is free speech, end of discussion.

It is time for the people to drag our political class, kicking and screaming, back to our Constitutional principles, back to a limited Federalist government. Let’s return meaningful power to the states so they can devise different solutions for our common problems. Let the people determine what works and what doesn’t.

Random thought: As the Totalitarian Socialist government of China is the sole source of the COVID virus which they exported around the world they should face sanctions. They banned all domestic flights to and from Wuhan but allowed international flights to be continued. They have lied about the origin and character of the virus. We must find a way to let people adversely impacted by the acts of China receive restitution. How about a 100% tariff on every product imported from China with the proceeds to be used to make payment to those who suffered?

  1. A brilliant synopsis of two and a half centuries of adept and inept governing. The most influential of my studies as a young university student, and throughout my entire life, was most certainly the discernment of human motivation, as advanced by Abraham Maslow. When overlayed against the concept of governance, the foibles, frailties and iniquities of our modern day leaders is quite easily understood. Although his “hierarchy” was predominantly positive in focus, I would argue that, for the evil of heart, a lust for power lies at the peak of “self-actualization.”
    As for extricating ourselves from our current volcano of corruption and partisanism, I fear the task is beyond Herculean! And, due to the unparalleled ignorance and stupidity of masses of the governed (so eloquently elucidated in Mencken, Barnum and Stupidity Applied) I fear it is unachievable. Any attempts to reform will be met with resistance beyond imagination.
    A successful convention of states may well be the only feasible way to start.
    Lastly, I offer the Texas governance model, which I believe is a truly magnificent blueprint for limiting the power of government. Texas legislators are part time employees of the people. The legislature meets every two years for five months from January to May. The concept automatically limits the amount of new laws, rules, regulations and restrictions on freedom that can be considered. Furthermore, to deserve consideration in the queue, the short legislative sessions require a high bar of importance.

    I would like to add to your 4th suggestion: If a member of congress benefits from his/ her role in the government after leaving office then he/ she must declare and surrender 90%. to the tax payers.

  3. What will you do when our hospitals are overwhelmed with the sick? How important will your shopping right be then? Your insistence on having your “freedom” is putting our healthcare workers at risk. After all everyone expects to be treated when they show up at the ER.

    Your statement about “transfer of power” makes no sense: “Unfortunately this power shift was accompanied by an asymptotic growth of mediocrity among those who would manage our live.” That’s laughable. Our country’s accomplishments have accelerated beyond anyone’s imagination since this “transfer of power” has taken place. Your argument has no evidence to support it.

    • I am glad I could make you laugh but I am sad that you have so little knowledge of our system. Rule of the day: The Federal government does NOTHING well. The shift of power to the federal level has been a disaster. Obamacare was a medical and economic catastrophe. The Great Society has been instrumental in the destruction of the black family. Capitalism has driven our freedom and our success and every time the government tries to “control” our lives disaster ensues. A country that is “managed” by such mediocrities as Pelosi, AOC, Schumer, Adam Schiff and James Comey is in deep yogurt. True talent is working in the capitalist system and those waving their useless Ivy League are slaves to their vainglory. Interestingly Trump is a political rarity, to wit, someone who has actually managed something to fruition.       • Obamacare May be a disaster but it is at least an effort to address healthcare. How is it that the Republicans Whined and cried about Obamacare since it passed, leveraged the Tea party, ran against Obamacare and held both houses of Congress for TRumps first two years and couldn’t even get the votes to repeal Obamacare let alone replace it.

        Now we going to approach 25% unemployment and how do Republicans suggest we provide health insurance… through the employer of course. And the argument that healthcare is a market is beyond laughable. Employer provided insurance delivered with tax exempt premiums … that’s not a market solution. Certificate of need laws to protect hospitals… that’s not a market. Limited number of medical school seats and residency programs ensuring doctors are instant 1%ers. That’s not a market.

        Dems offered a bad solution but Republicans offered nothing. Maybe their fecklessness keeps the Dems in powerful positions.

      • What a bouillabaisse of propaganda. Our health care system is the best in the world bar none. When Castro needed a specialist they flew one in from Spain and when Jagger needed heart surgery he came post haste to America. In fact they were one vote from a repeal when the pusillanimous John McCain (dumbest man ever to run for President) voted no because he didn’t like Trump. I would love to increase the number of doctors but I fear that your argument would then shift to unqualified doctors who are hurting their patients and implement costly controls. I would give immunity to doctors for every thing but gross negligence. A huge part of medical costs involve insurance costs and that is driven by an out of control legal community. Let’s reduce the number of lawyers and increase the number of competent doctors. Kermit Gosnell need not apply. You suggest employer provided insurance is not a market solution yet more than 50% of Americans don’t want to lose it.
        I think the solution is to de-control healthcare. Despite the arguments you make there are few cases where people are turned away from emergency rooms. If people were refused care it would be front page news everywhere.
        Obamacare was and is a disaster. Let’s get rid of it and start over. Sadly bi-partisan solutions are impossible because the likes of Schumer and Pelosi do not want to fix the problem.

Explain how “accomplishments have accelerated” since the consolidation of power in Washington. I have yet to hear any info to support your proposition.

  4. I like most of the recommendations, but term limits are a red herring. If the voters are tired of an official simply because he’s been in office a certain number of years, his opponent should run on that issue.

    I have to disagree with this returning power to the people. This is such a boomer slogan. Where were all the people when the power was being taken away? They were at the ball game or the movies or watching some worthless sitcom like friends Seinfeld or whatever.

    The fact is the people have the government they deserve and most likely the one they want. Ultimately Americans want a bread and circuses culture where they work enough to pay Minimum balance on their home equity line So they can go in a cruise or remodel the kitchen so the neighbors will be green with envy. They’d prefer to outsource hard decisions to Washington or whoever.

    That’s how we ended up here and likely why we will continue in the death spiral.

    I do disagree but to your dismay I won’t “hit and run”. Allow me to rebut and dispel some of your bombastic rhetoric.
    You so quickly toss the government aside but a lot of your GOP supporters are the first ones to ask for a government bailout, as I am typing these lines. Even some of the most free-market enterprises we have in our country are lining up with their tin cup. It wasn’t too long ago they hand-waved the government off and its collection of corporate taxes and, now, in a great show of hypocrisy they warn of extinction without the evil government’s help.
    I am a free-market capitalist like the rest of my fellow democrats but we realize the system has to have its controls and it has to have some interventions and corrections. You can thank your despised Obama for bailing out several industries and companies after the financial crisis, which was caused by an unchecked, greedy system. Where would all these companies and employees be now? Your mortgage would be served by the Bank of Beijing now had it not been for Obama.

    Let’s take the most economically free country in the world, 12 years running: Hong Kong (US was ranked 9th). I don’t know if you have ever been there but I spent a good portion of my life there. Sure, there are many rich people there but there are thousands of people that live like animals – literally, in 9X9 cages. There is nothing humane about that society. Is this what success and free-market glory look like? Is this what the GOP is striving to achieve here?

    Whether Obamacare was a success or failure is in the eye of the beholder. I see Obamacare adding millions of uninsured people to the privilege of being able to see a doctor.
    As you can see some government is good!

    • Where to begin. Short easy putt first. Obama care added 9 million people and drove 20 million people out of the system because the costs became prohibitive. I did not have to endure Common Core math so I can readily see that the program reduced coverage by 11 million people. Obama never expressed a moment’s concern about this failure. In addition nationalized healthcare has never, ever worked. When Castro needed special care they flew in a specialist from Spain. When Jagger needed heart surgery he came to the US.
      I have always been opposed to bailing out banks. The housing market crash of 2007-8 was caused by the Federal government. It was a victim of the Community Reinvestment Act used by Clinton to force the banks to give mortgages to people who could not afford to pay them. It was the exact same pattern used in the 1920’s that caused the Great Depression…also a product of Federal interference. Obama did precisely nothing to resolve the issue unless you count quantitative easing and zero interest rates. Are you even aware that the largest contributors to the Obama campaigns were the banks? That data point is studiously ignored by the media. Obama set out to destabilize the Middle East and he came close to exceeding.
      You lost all of your credibility when you said: I am a free-market capitalist like the rest of my fellow democrats. There aren’t five elected Democrats in this country who can even define free market capitalism. AOC is a honors graduate of BU majoring in Economics and she refers to Milton Keynes. I actually pulled a rib muscle laughing when I read that comment. There hasn’t been a pro-capitalism Democrat President since Grover Cleveland. Democrats are instinctively authoritarian. In addition the party has been engaged in black repression for 200 years. They want to create a system which requires dependence. Please send me five quotes from Democrats in the last 25 years that support free market capitalism.
      I have been to Hong Kong on a number of occasions but not since the late 1970’s. It was a thriving economy but like every society there was poverty. But unlike most societies there is the real possibility of achieving success. Odd that you would focus on Hong Kong as the example of capitalism. I would rather look at US history after the Civil War. Capitalism was practiced from coast to coast and never in world history has so much wealth been created. The measure of our success has been the mobility of Americans within the system. Many studies show that the average American spends time during their lives in 3 of 5 income quintiles. That mobility tends to slow down when the economy becomes centralized. The UK is a perfect example. Did you travel to the Philippines or Malaysia? The poverty was far worse that Hong Kong and these were not capitalist economies.
      You have provided no evidence that centralized government is good but I look forward to your taking another swing. And we haven’t even dealt with the hoax that is anthropogenic climate change. That is a Democrat wet dream that is ant-science on steroids.
      In any case I love your enthusiasm as misplaced as it is.
